SD Howell Ltd trading as Performance Resourcing is a recruitment agency and is a UK registered company.

We are committed to protecting the privacy of our candidates, clients and users of our website and to providing a safe and secure user experience. We will endeavour to ensure that the information you submit to us remains private and that it is only used for the purposes described below. We make every effort as a Data Controller to comply with our obligations under the Data Protection Act 2018, which complements the EU General Data Protection Regulation (GDPR).

1. What personal data do we collect

  • Data you supply directly to us, including CVs.
  • CVs found through searches, or received via watchdogs, on CV hosting sites (including: jobsites, social media or other sites).
  • The data involved in the processing of any job vacancy or job application submitted to us.
  • Information that is connected to the provision of any other services you have requested.

This data may include your name, address, email address, phone number, current employer, information from your CV and any other relevant information that you provide.

2. How we store and use the data we collect

All data received will be stored securely on our IT systems and processed only with your consent or for our legitimate interest. Our data processing IT providers, i.e. Data Processors, may use servers and IT technical support in the UK, European Economic Area (EEA), USA and Australia. They have agreed to comply with the GDPR and EU–US Privacy Shield Framework.

Performance Resourcing Limited will collect, hold, use, or disclose your information for the following reasons:

Candidates and Clients and Users of our website

  • In General
    • To provide our services to you and to respond to your requests or enquiries, or to offer general support.
    • To maintain an ongoing business relationship with you.
    • To ensure the information we hold is accurate and up to date.
    • To research and analyse ways to improve our services to you.
    • For good governance, accounting and managing and auditing our business operations.
  • In addition, specifically relating to Candidates:
    • To enable you to submit your CV to us.
    • To assist us in recording your details on our database.
    • To process any job applications, you make.
    • To match your details with job vacancies.
    • To help find a suitable position for you.
    • To submit your CV to appropriate clients (we aim to never send your CV to any client without discussing it with you first).
    • For marketing purposes, to alert you in the future to jobs/career opportunities which may be of interest to you (with your specific consent).
    • You can update your CV at any time simply by submitting a new CV to hello@performanceresourcing.co.uk
  • In addition, specifically relating to Clients:
    • To contact you to discuss the recruitment, training or other needs of your business.
    • To provide information regarding potential candidates for job vacancies.
    • To assist with the processing of any candidate you wish to shortlist, interview or employ.
    • Clients are expected to comply with the GDPR in their processing of candidate CVs which we forward to you.

4. Who we share your personal data with

We may have to share your data with the parties set out below:

  • Candidate CV’s are shared with Clients where there is a match of the skills of the Candidate and the business requirements of our Clients (we aim to never send your CV to any client without discussing it with you first).
  • Our IT providers who supply our IT systems and provide technical support in the UK, EU, European Economic Area (EEA), USA and Australia. Our data processors comply with the GDPR and EU – US Privacy Shield Framework.
  • Professional advisors who provide consultancy, legal, insurance and accountancy services.
  • Third parties to whom we may choose to sell, transfer or merge parts of our business or our assets. If a change happens we will notify you immediately.
  • Information may be released to regulatory or law enforcement agencies if they so request.
  • Third party marketing – We never share your personal data with any company outside SD Howell Ltd trading as Performance Resourcing for marketing purposes.

5. What are your personal information rights in relation to the data we hold on you?

  • Access: You have the right to request us to provide you details of the personal information we hold about you. (We may ask you to verify your identity.)
  • Correction: You have the right to ask us to correct our records if you believe they contain incorrect or incomplete information about you.
  • Erasure: You have the right to Data Erasure (the right to be forgotten), without undue delay, of your personal information for which you later withdraw your consent to processing, or when it is no longer relevant to the original purposes for which it was collected. This is not a general right to erasure there are exceptions.
  • Processing Restrictions: You have the right to temporarily restrict our processing of your personal information if: you contest the accuracy of your personal information; you prefer we restrict its use rather than erase it; you need it to be preserved to establish, exercise, or defend a legal claim; whilst you are verifying whether we have overriding legitimate grounds to use it. You have the right to be informed before we lift the processing restriction.
  • Data Portability: You have the right to ask us to provide personal information about you, which you have previously provided in a commonly used and machine-readable format, to transmit it directly to another controller if this is technically feasible.
  • Withdrawing Consent: If you have given your consent to anything we do with your personal data, you have the right to withdraw your consent at any time. This, however, does not mean that anything we have done with your personal data with your consent up to that point is unlawful.
  • Right to Object to Direct Marketing: You always have the right to object to receiving direct marketing from us even if we believe that we have a legitimate interest to communicate with you in this way. You can contact us to request that we stop all direct marketing.
  • Data Security and Data Breach: We are committed to ensuring personal information is secure. We have put security measures in place to protect against the loss, misuse, and alteration of personal information under our control. Unfortunately, the transmission of data across the internet is not completely 100% secure and whilst we do our best to try to protect the security of your information, we cannot ensure or guarantee that loss, misuse or alteration of data will not occur whilst data is being transferred. We also have administrative procedures in place to only allow authorised personnel to access systems containing personal information. In the unlikely circumstances of a data breach occurring that results in a risk to your rights and freedoms as an individual, we will inform you within 72 hours of our first becoming aware of any such breach which affects your personal details held by SD Howell Ltd trading as Performance Resourcing.
  • Data Retention: We will keep personal information only for as long as we need it to maintain our relationship with you, provide you with the services or information you requested, to comply with the law, and to ensure we do not communicate with individuals that you asked us not to. When we no longer need the information, we will delete it from our database. We will seek permission for the storing of personal data on a continuing basis to ensure it is up to date and accurate and to check if you wish to renew your consent for us to continue to hold your details.
  • Right to Lodge a Complaint: You have the right to lodge a complaint about the way we handle or process your personal data with the UK’s data protection supervisory authority via the Commissioner’s Office online at https://ico.org.uk/concerns/handling/
